After Harvey inundated  Houston and the surrounding area with rain, many Houston properties were not flooded.  However, that changed as the U.S. Army Corps of Engineers did controlled releases of water from the two dams, the Addicks and Barker dams.  The reason given for the release was to prevent failure of the dams and create more room for additional water.

The Army Corp Engineers usually allow water from the reservoirs to be released at 2,000 cubic feet per second, but due to the large amount of water from hurricane Harvey, the Army Corp of Engineers raised the rate to 13,000 cubic feet per second. The justification was draining the dams more quickly would reduced their risk of breaching.
 
Woodfill Law Firm, PC is pursuing claims against the Harris County Flood Control District and the City of Houston, contending that inverse condemnation occurred when the government Engineers made an intentional decision to take private property for public use without first filing a lawsuit. By intentionally choosing to flood an area by releasing excess dam water, the government chose to “take” private property for the benefit of the public.
 
Assuming the release was done for a public purpose, homeowners and businesses must still be compensated for their losses.
